Account Creation and Use

Eligibility

On Ouzox, 13-year-olds can create accounts. Anyone under 18 must have permission from a parent to upload content.

You must be at least 13 years old to create an Ouzox account. If you are under 18, your parent or guardian must consent to create and upload content on the platform.

Parents & Guardians

Parents are responsible for monitoring the content they consume and create on the platform.

Parents or guardians are responsible for making sure their child on the platform is playing games approved by them.

If you are under 18, you agree that the content you upload on the platform has been approved by your legal parent or guardian for us to sell, distribute, etc.

Account Security

You are responsible for the security of your account on Ouzox

Users are solely responsible for maintaining the confidentiality of their account information, including their passwords. It is important to ensure that passwords are strong and are not shared with others. In case of any unauthorized access or security breach, users must contact Ouzox.

Acceptable Use

If you misbehave, we'll terminate your Ouzox account.

Ouzox is a safe platform and service for site users. This requires the community to have responsible behavior among its members. You agree not to do any prohibited actions on the platform.

Prohibited actions include, but are not limited to:

1. Uploading harmful software or viruses.

2. Sending or spamming repeated messages.

3. Publishing content that is illegal, deceptive, hateful, or discriminating is intimidating, harassing, threatening, defaming, or bullying someone else while also breaching their legal rights.

4. Publishing anything that encourages or takes part in hate crimes, hate speech, misogyny, racism, or intolerance toward any group of people.

5. Obtaining, gathering, or soliciting personal data from others.

6. Publishing content without permission and violating their copyright, trademark, or other property or legal rights means fabricating a persona to deceive people.

7. Breaking any applicable laws or rules.

Prohibited actions will result in termination without prior notice.

User-Generated Content

You allow Ouzox to promote your game with the material you provided us. You affirm that you have the right to upload and sell your content and that Ouzox and its users can use/purchase your content without violating anyone else's rights.

You retain ownership of any content that you upload to the platform. Still, by uploading content to the platform, you grant the following:

1. A non-exclusive, royalty-free license to use, modify, and distribute that content to Ouzox to operate the platform.

2. A non-exclusive, perpetual license to access, use, and display that content to the downloader as permitted through the functionality of Ouzox. Downloaders will keep this license for as long as they have the content.

The downloader cannot distribute or share the file with anybody else without the publisher's consent. This act will result in termination.

Ouzox provides users with tools to upload content and make it available to other users. By uploading or creating user-generated content, you grant Ouzox a worldwide, non-exclusive, perpetual, royalty-free license to use, reproduce, create display, perform, and distribute the user-generated content.

Suspension and Termination

Violate these terms and we terminate your account at any time without notice.

Ouzox reserves the right to terminate your access to the platform at any time, without notice or liability. Upon termination, your user-generated content will be deleted.

Any violation of the Terms of Service will result in suspension and termination of your Ouzox account.

Intellectual Property

Everyone on this platform has rights. Infringing them will result in account termination.

Ouzox and its users retain all rights to their intellectual property, and infringement of those rights will not be tolerated and will result in account termination.

Digital Millennium Copyright Act

If you believe one of the Publishers has violated your copyright, please let us know with the required information. If you think a complaint was filed in error, you can also contact us to address your concerns.

Ouzox respects the intellectual property rights of others. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please contact us with the following information:

• A physical or electronic signature of the copyright holder or their authorized representative.

• Identification of the copyrighted work claimed to be infringed.

• Identification of the infringing material and its location on the Ouzox platform.

• Contact information of the complaining party.

• A statement that the complaining party has a good faith belief that the use of the material is not authorized by the copyright holder.

• A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.

Failure to comply with the requirements of this section may invalidate your DMCA notice.

If you believe your content was removed in error, you may submit a counter-notice by contacting us. Ouzox reserves the right to terminate the accounts of repeat infringers.

Purchases and Refunds

Payment Processing

We use Stripe to process transactions. Creators on the platform must accept their terms along with ours.

Publishers who distribute content on Ouzox agree to the acceptable use policies of our third-party payment processor: Stripe.

Pricing and Taxes

Publishers can set prices for their content. We are entitled to a cut of their income on the platform.

Publishers have the right to evaluate and set the price of content they own on the platform. Their content must be sold through Ouzox and we shall be entitled to a share of the revenue publishers receive which shall be calculated on the gross revenue.

Publisher Account Responsibilities

Publishers are held accountable for their content on the platform. We can terminate it at any time.

Publishers hold full responsibility for the content they create on the platform. Just like account termination and suspension, Ouzox reserves the right to terminate your access to your UGC on the platform.

Your content on the platform violating the quality guidelines or the Terms of Service is entirely your responsibility.

Legal Disclaimers and Protections

Warranty Disclaimer

Ouzox provides the Ouzox platform and all content and services available on or through the platform "as is" and "as available," without warranty, express or implied.

Ouzox specifically disclaims all implied warranties, including but not limited to, warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Ouzox does not warrant the platform being uninterrupted, error-free, or free of viruses or other harmful components.

Ouzox does not warrant the accuracy, completeness, or usefulness of any third-party content available on or through the platform. Ouzox is not responsible for any loss or damage caused by your reliance on such third-party content.

Limitation of Liability

In no event shall Ouzox be liable for any indirect, incidental, special, consequential, or punitive damage arising out of or related to the use of or inability to use the platform, even if Ouzox has been advised of the possibility of such damages.

Ouzox's total liability to you for any cause of action arising out of or related to this agreement or the platform whether in contract, tort (including negligence), or otherwise, will be limited to the amount you paid to Ouzox, if any, in the 12 months before the event giving rise to the liability.

Indemnification

You agree to indemnify and hold harmless Ouzox from any damages or liabilities arising from your platform use.

Governing Law and Dispute Resolution

This Warranty Disclaimer shall be governed by and construed by the laws of Oklahoma, without regard to its conflict of law principles.

By using the platform, you agree to be bound by these terms. If you do not agree to these terms, please do not use the platform.

Updates and Modifications

Terms of Service Updates

Ouzox reserves the right to update these terms at any time, and by continuing to use the platform, you agree to be bound by the updated terms. Ouzox will provide notice of any material changes to these terms through the Ouzox blog.
